Limited Warranty

Limited Warranty for Gustaf-Guard™ sawblade protector.

This Limited Warranty (“Warranty”) is provided by Gustaf Outdoors LLC (“Manufacturer”) to the original purchaser (“Purchaser”) of the Gustaf-Guard™ (“Device”). This Warranty covers the Device and its components against defects in materials and workmanship for a period of 60 days from the date of purchase (“Warranty Period”).

Warranty Coverage

During the Warranty Period, Manufacturer warrants that:

  1. The Device will be free from defects in materials and workmanship under normal and intended use.
  2. In strict accordance with the Exchange Policy, if a defect arises during the Warranty Period and is reported to Manufacturer within the Warranty Period, Manufacturer will, at its sole discretion, either repair or replace the Device with a new or refurbished Device.

Warranty Limitations

This Warranty does not cover:

  1. Damage, malfunction, or defects resulting from misuse, abuse, neglect, accidents, or unauthorized alterations or repairs.
  2. Damage caused by improper installation, maintenance, or handling of the Device.
  3. Normal wear and tear, cosmetic damage, or deterioration due to normal usage.
  4. Devices that have been used for commercial or industrial purposes.
  5. Devices not purchased from an authorized reseller.

Making a Warranty Claim

To make a claim under this Warranty, Purchaser must:

  1. Contact Manufacturer’s Customer Support within the Warranty Period by email at [email protected].
  2. Provide proof of purchase (e.g., original sales receipt or invoice) and a detailed description of the defect or malfunction including photos.
  3. Follow Manufacturer’s instructions for returning the Device, if required.

Manufacturer’s Obligation

If a valid Warranty claim is made within the Warranty Period and in compliance with this Warranty, Manufacturer will, at its sole discretion, repair or replace the Device. The repaired or replaced Device will be covered for the remainder of the original Warranty Period or 30 days, whichever is longer.

Limitation of Remedies

Manufacturer’s sole obligation under this Warranty is to repair or replace the Device, as described above. This shall be the sole and exclusive remedy for any breach of this Warranty.

Disclaimer of Other Warranties

EXCEPT FOR THE EXPRESS WARRANTIES PROVIDED HEREIN, MANUFACTURER DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MANUFACTURER DOES NOT WARRANT THAT THE DEVICE WILL MEET PURCHASER’S REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

MANUFACTURER SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR INTERRUPTION OF BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE DEVICE, EVEN IF MANUFACTURER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Law

This Warranty is governed by and shall be construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws principles.

Entire Agreement

This Warranty constitutes the entire agreement between Manufacturer and Purchaser regarding the Device and supersedes all prior or contemporaneous understandings, representations, or agreements, whether oral or written.

Effective Date

This Limited Warranty is effective as of November 24, 2023.

By purchasing and using the Device, Purchaser acknowledges and accepts the terms and conditions of this Limited Warranty.
